Welcome to Find a 4th. These Terms of Service ("Terms") govern your use of the Find a 4th application and website (the "Service"), operated by Personalized Chaos LLC ("Find a 4th," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and able to enter into a binding agreement.
2. Your Account
You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that happens under your account. Please provide accurate information and keep it up to date. Notify us promptly of any unauthorized use of your account.
3. The Service and Beta Status
Find a 4th helps players find partners, post and join games, receive recommendations for nearby players, and connect within the player network.
The Service is currently offered as a Beta. This means features may change, be added, or be removed, and the Service may contain errors or be unavailable at times. We provide the Beta "as is" and make no guarantees about availability, reliability, or specific features.
4. Player Conduct and Community Rules
When you use the Service, you agree not to:
- harass, threaten, abuse, or harm other players;
- create false or misleading profiles, or impersonate others;
- misrepresent your skill level or identity;
- use the Service for any unlawful purpose;
- spam, solicit, or send unwanted commercial messages;
- attempt to interfere with, disrupt, or gain unauthorized access to the Service.
We may suspend or terminate accounts that violate these rules or that we believe pose a risk to other users or the Service.
5. Player Interactions and Safety — Please Read Carefully
Find a 4th is a platform that helps players find and arrange games. Games and meetups take place in person, in the real world, and may involve meeting people you do not know.
You understand and agree that:
- We do not conduct background checks or otherwise screen or verify players, including their identity, skill level, DUPR rating, or conduct.
- We are not responsible for the actions, behavior, or safety of any player, on or off the court.
- You are solely responsible for your own safety and decisions when arranging or attending games, meeting other players, or traveling to and from courts.
- Pickleball and other physical activity carry inherent risks of injury. You participate at your own risk.
Please use good judgment, meet in public places, and take the same precautions you would when meeting anyone new.
6. User Content
You retain ownership of the content you submit, such as your profile information, game posts, and messages. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content as needed to operate and provide the Service. You are responsible for the content you submit and must have the rights to share it.
7. Communications and Notifications
By using the Service, you agree that we — and the Service acting on your behalf — may send you messages, invitations, and notifications related to games, recommendations, and your account, including by push notification, email, or in-app message. You can manage notification preferences in the app or your device settings. Some account-related communications are necessary to provide the Service.
8. Intellectual Property
The Service, including its name, logo, design, software, and content (other than user content), is owned by Find a 4th and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our permission.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that recommendations or matches will meet your expectations.
10. Limitation of Liability
To the fullest extent permitted by law, Find a 4th and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss or injury arising from your use of the Service, your interactions with other players, or any games or meetups arranged through the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us in the prior 12 months, or $100, whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless Find a 4th and its owners, employees, and partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, your interactions with other players, or your violation of these Terms.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we believe it is necessary to protect the Service or other users.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any disputes arising from these Terms or the Service will be resolved in the courts located in Maricopa County, Arizona, unless otherwise required by law.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other means. Your continued use of the Service after the changes take effect means you accept the updated Terms.
